Important. By accessing this Site or purchasing from us, you consent to the collection, use, and disclosure of your information as described in this Policy. We comply with applicable privacy law where required. We make no commitments beyond what applicable law requires of us. We may update this Policy at any time, in our sole discretion, without prior notice, and your continued use of the Site constitutes acceptance.

1. Who we are

This Privacy Policy describes how NailScience ("NailScience," "we," "us," or "our") collects, uses, and discloses information when you visit trynailscience.com (the "Site"), interact with any of our digital properties, or purchase a NailScience product. The Site is operated in the United States and is intended for users located in the United States. If you access the Site from outside the United States, you do so at your own risk.

2. Information we may collect

We may collect, in our discretion, any information you provide and any information generated by your use of the Site, including without limitation:

  • Name, billing and shipping address, email address, telephone number, payment-related identifiers.
  • Order, transaction, return, and customer-service history.
  • Communications you send to us, including content of customer-support emails, chat messages, surveys, product reviews, photographs, and user-submitted content.
  • Marketing preferences and consent records.
  • Technical and device data: IP address, device identifiers, browser type, operating system, time zone, language, referring URL, pages viewed, click events, session duration, screen size.
  • Cookies, pixels, web beacons, tags, software development kits (SDKs), local and session storage, and other tracking technologies, including those operated by third parties.
  • Advertising and attribution identifiers, including click identifiers from Meta, Google, TikTok, Microsoft, and other advertising platforms.
  • Information obtained from third parties, including advertising platforms, fraud-prevention vendors, payment processors, our checkout provider, and publicly available sources.
  • Inferences drawn from any of the above.

3. How we may use information

We may use information for any lawful purpose, including without limitation:

  • Processing orders, payments, returns, and customer-service requests.
  • Communicating with you about your orders, account, and customer service inquiries.
  • Marketing, advertising, promotions, retargeting, lookalike modeling, and audience matching across our channels and third-party platforms.
  • Measuring and optimizing the performance of our marketing, conversion rates, and the Site.
  • Personalizing your experience and content shown to you.
  • Detecting, preventing, and investigating fraud, abuse, chargebacks, returns abuse, and security incidents.
  • Enforcing our Terms of Service and other agreements.
  • Defending or asserting legal claims and complying with legal obligations.
  • Any other purpose disclosed to you at the time of collection, or any purpose reasonably related to those above.

4. How we may disclose information

We may disclose information to the following categories of recipients, in our discretion, without further notice to you:

  • Service providers and vendors that perform services on our behalf (including without limitation checkout, payment processing, fulfillment, logistics, customer service, email and SMS, hosting, content delivery, analytics, fraud prevention, and legal advisors).
  • Advertising platforms, ad networks, and measurement providers (including Meta, Google, TikTok, Microsoft, and similar providers) for the purposes described in Section 3, including via server-side conversion APIs and identifier-matching workflows.
  • Affiliates, parent, subsidiary, and successor entities.
  • Acquirers and prospective acquirers, lenders, professional advisors, and counterparties in a business transaction, including a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or other corporate transaction.
  • Law enforcement, regulators, courts, and other governmental authorities where we believe disclosure is required or appropriate to comply with law or legal process, to protect our rights or those of others, or to enforce our agreements.
  • Any other party with your consent.

To the extent any disclosure described above constitutes a "sale" or "sharing" of personal information under applicable state privacy law, you may have the right to opt out as described in Section 7. We do not exchange personal information for cash consideration.

5. Cookies, pixels, and tracking

We and our service providers and advertising partners use cookies, pixels, web beacons, SDKs, tags, and similar technologies to operate, secure, analyze, advertise, and personalize the Site. Categories include strictly necessary (cart, checkout, security, fraud prevention), analytics and performance, advertising and conversion measurement (including server-side conversion APIs), and functional/preferences. You may manage non-essential cookies through the cookie banner where presented, or by configuring your browser. Refusing cookies may degrade or prevent your ability to use parts of the Site.

6. Retention

We retain information for as long as we deem necessary for our legitimate business purposes, including without limitation order fulfillment, customer service, fraud prevention, marketing, dispute resolution, defense of legal claims, and compliance with applicable legal, tax, accounting, and audit obligations. We do not commit to specific retention windows.

7. Your rights (where required by law)

7.1 California (CCPA / CPRA)

If you are a California resident, applicable law gives you the right to: (i) request to know what categories and specific pieces of personal information we have collected, used, or disclosed about you in the preceding 12 months; (ii) request deletion of personal information, subject to exceptions; (iii) request correction of inaccurate personal information; (iv) opt out of the "sale" or "sharing" of personal information for cross-context behavioral advertising; (v) limit the use and disclosure of sensitive personal information; and (vi) be free from retaliation for exercising these rights. We will respond to verifiable requests within the time period required by applicable law. We may decline requests where exceptions apply.

7.2 European Union, United Kingdom, Switzerland

If you are located in the EU, UK, or Switzerland, you may have rights of access, rectification, erasure, restriction of processing, data portability, and objection to processing, as well as the right to withdraw consent and to lodge a complaint with a supervisory authority. Rights are not absolute and may be limited or refused where required or permitted by applicable law.

7.3 Other US states

If you reside in another US state with a comprehensive consumer privacy law, you may have rights similar to those described in Section 7.1, subject to the specifics and limitations of that state's law.

7.4 How to submit a request

To submit a request, email privacy@trynailscience.com. You must provide the email address associated with your purchases and any additional information we reasonably require to verify your identity and the scope of your request. Requests submitted through any other channel may not be processed. We may charge a reasonable fee or refuse a request that is manifestly unfounded, excessive, or repetitive, to the maximum extent permitted by applicable law.

7.5 Authorized agents

You may designate an authorized agent to submit requests on your behalf. We may require written authorization signed by you and may take additional steps to verify the agent's authority and your identity.

8. Children

The Site is not directed to children under 13 (or under 16 in the European Union and United Kingdom). We do not knowingly collect personal information from such children. If you believe we have collected such information, contact us at privacy@trynailscience.com and we will take appropriate steps as required by applicable law.

9. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect the information we hold. No method of transmission or storage is secure, and we make no representation, warranty, or guarantee that information will not be accessed, disclosed, altered, or destroyed without authorization. You provide information to us at your own risk.

10. International transfers

Information we collect is processed and stored in the United States and may be transferred to or accessed from other jurisdictions. By using the Site, you consent to such transfers and to the processing of information in jurisdictions whose data-protection laws may differ from those of your country.

11. Third-party links and platforms

The Site may link to or interoperate with third-party sites, applications, and platforms. We are not responsible for the practices of those third parties. Review their privacy policies before providing information.

12. Marketing communications

By providing your email address or phone number and opting in where required, you consent to receive marketing communications, including automated email and SMS messages. You may opt out of email marketing by following the unsubscribe instructions in any marketing email, and out of SMS marketing by replying STOP. Opting out of marketing does not stop transactional communications relating to your orders, account, or legal notices.

13. Health-related information

If you choose to share health-related information with us — for example details about a nail or skin condition in a customer-service message, survey, or review — you do so voluntarily. NailScience is not a HIPAA-covered entity and is not subject to HIPAA. Any health-related information you share is treated as ordinary personal information under this Policy and may be used and disclosed as described above. Do not send us protected health information from a healthcare provider.

14. Changes to this Policy

We may modify this Policy at any time, in our sole discretion, with or without prior notice. The "Last updated" date above reflects the most recent revision. Your continued use of the Site following any change constitutes your acceptance of the modified Policy.
